The 12th meeting of ETSI Technical Committee Electromagnetic Compatibility and Radio Spectrum Matters (ERM) took place in ETSI headquarters, Sophia Antipolis from 6 to 10 November 2000, at the invitation of the ETSI Secretariat.

The meeting was opened by Michael Sharpe, who welcomed the delegates to Sophia Antipolis and wished them a successful meeting.

The meeting was chaired by Mr Oliver Wheaton (DTI); the Secretary was Dr Michael Sharpe (ETSI Secretariat).

The draft agenda (document 12_001r5) had been circulated prior to the meeting. The adopted agenda is attached as annex A. The Chairman introduced document 12_002r1, highlighting certain points to the delegates.

The meeting noted document 12_023, the draft report of the 4th meeting of the ETSI Future Role Implementation Group.

The meeting noted that EFRIG was expected to report to the 36th General Assembly. This was discussed in detail under agenda item 1.3.2.

The meeting noted that the 36th General Assembly was scheduled to meet on 21 to 22 November 2000.

It was noted that the ETSI annual running cost is about 20 million Euro, and that the reserve is about 5 million Euro. The financial structure will be discussed at the next GA.

This was discussed under agenda item 4 (ERM EMC) and agenda item 5 (ERM RM).

It was noted that ERM RM had agreed a liaison statement to EP PLT on matters related to the use of the HF band by PLT services. Some concern was expressed at what appeared to be a negative approach from ERM RM.

The meeting considered document 10_031, a letter sent to the TCAM Secretary after ERM#11 regarding Environmental Conditions, and document 10_089, the draft minutes of the 6th meeting of TCAM.

The meeting noted that the Commission had discussed receiver parameters and environmental conditions, as reported to the last meeting of the R&TTE Steering Committee. It was reported that the Commission consider that certain parameters should not be included in Harmonised Standards, and that the Commission were considering deleting such requirements from the Harmonised Standards before citing them in the Official Journal. It was noted that the Commission comments also apply to radio standards produced outside ERM.

It was agreed that specified receiver parameters are necessary as frequency planning assumptions as part of a spectrum management régime. Users can expect to benefit from spectrum protection only if the receiving equipment meets certain quality requirements. It was noted that the existing "part 1" standards fulfill this purpose.

The meeting noted document 12_090, a draft mandate on electrical safety that had been agreed by the 98/34 Committee. It was noted that CENELEC was the lead organisation on this mandate, and that TC Safety provided technical assistance on telecommunications aspects. It was noted that the competence regarding safety on radio sites was shared between TC Safety WG radio and ERM RP11. This was further discussed under agenda item 10.

The meeting noted document 12_103, a draft ITU-R Recommendation on Short-Range Devices. This was discussed under agenda item 9 Report from WG ERM-RP08 (Land mobile ‘C’).

It was noted that WP8B were working on a revision on the ITU-R Recommendations on Digital Selective Calling.

The meeting also noted document 12_111, a report of ITU-R SG1.

The meeting noted document 12_025, a revised basic agreement between CEN, CENELEC and ETSI.

The meeting noted document 12_061, a liaison statement on support for TBRs. The meeting noted that the liaison statement concerned non-radio TBRs.

The meeting noted document 12_105 and document 12_107 on relations between IEC and ERM TG17. This was discussed in detail under agenda item 17 Report from Task Group 17 (Broadcast and ancillary communications equipment).

The meeting noted documents 12_096 and 12_097, the status of documents approved at ERM#10bis and ERM#11 respectively.

It was noted that all documents were progressing according to plan, except the following:

The meeting endorsed the view of ERMCC to set up a task group to review the ERM Harmonised Standards in the Land Mobile sector, in the light of the view expressed by the European Commission, with the reservation of Secretariat d’Etat d’Industrie. The task group should consider, inter alia, receiver parameters and environmental conditions. It was noted that the Commission (Mark Bogers) intends to attend the Task Group. It was considered that, in cases where receiver parameters were justified, that justification should be made clear to the Commission.

It was noted that RP02 consider that the issue of receiver parameters should be treated separately from environmental conditions.

It was noted that work on the related "part 1" standards should be suspended while the task group is working on the relevant Harmonised Standard.

Concern was expressed by France Télécom and Secretariat d’Etat d’Industrie that ERM had already stated its support for the published Harmonised Standards and that the action of the Task Group could be better handled by asking for a justification from the working groups that drafted those standards of the technical parameters chosen.

The meeting considered document 12_122, the draft Terms of Reference of TG18. The draft Terms of Reference were modified after considerable discussion. The meeting agreed that the Marine standards and the Avalanche Beacon standards are outside the scope of TG18. The revised Terms of Reference are attached as Annex F: Terms of Reference of ERM TG18 to review and revise Land Mobile harmonised standards within TC-ERM. A show of hands indicated a substantial majority in the meeting to set up TG18 with these Terms of Reference. Objections were noted from France Télécom and Secrétariat d’Etat d’Industrie. A statement from the representatives of France Télécom and the Chairman of RP02 are attached as (Annex O: Objections of the ERM RP02 Chairman to the Terms of Reference of TG18 and Annex P: Objections of France Télécom to the Terms of Reference of TG18).

The meeting noted that comments (document 12_033) related to the timing of the citation in the OJEC of EMC Harmonised Standards and Harmonised Standards under article 3.2 of the R&TTE Directive. It was reported that this issue had been discussed with the Commission (Mark Bogers) who would manage co-ordination between the different services within the Commission.

The meeting noted that a draft revision of the EMC Directive (document 12_035) had been discussed by ERM EMC, which had communicated its findings to the Commission via the ETSI Secretariat. The European Commission had subsequently issued a revised draft (document 12_082).

The meeting noted that comments from DARC (document 12_045) had been taken into account in the latest draft.

The meeting noted comments from the Slovak NSO (document 12_047), and a draft response from the ERM EMC vice Chairman (document 12_100).

It was noted that the comments indicated an inconsistency in methods of measurement, which relate to the functional radio parameters, rather than the EMC parameters.

RP02, RP08

To consider the technical issues raised by the Slovak NSO (document 12_047) in drafting future versions of radio performance standards.

It was noted that the joint work between CENELEC and ETSI on the resistibility report had been completed, and that CENELEC had published the report (document 12_059). There is no further work underway in ETSI on this topic.

The meeting noted an invitation to a workshop organised by the European Commission and the European Cable Communications Association (document 12_062) on EMC from cable distribution systems.

Mr Storrs and Mr Lindfors were appointed to attend the EC/ECCA workshop on EMC from cable distribution systems to represent the views of ETSI.

The meeting noted document 12_116, a report of the CENELEC/ETSI joint working group on EMC for cable distribution networks. It was noted that the JWG had set up a task group (TG3) to develop EMC emissions limits for cable telecommunication networks. It was also noted that CENELEC SC 201A had set up a working group (WG 7) to develop limits for emissions from other installations.

The meeting noted document 12_117 on EMC for Powerline Telecimmunications. The meeting noted that EMC requirements for PLT network equipment would be developed within ERM EMC (incorporated in EN 300 386). EMC requirements for PLT terminal equipment would be developed within CENELEC SC 210A (incorporated in EN 55022).

The meeting noted document 12_099 the report of an EMC study meeting chaired by the European Commission. The meeting noted that a report on technical aspects of EMC had been commissioned by the EC to give them technical guidance in developing the draft revision of the EMC Directive. It was reported that the draft was expected to be made available to ETSI shortly for comment. It was anticipated that the period allowed for comments would be short.

It was proposed to set up a task group, with Terms of Reference in document 12_125. After discussion, the Terms of Reference were modified as Annex N: Terms of Reference of TG19 on the EC EMC study.

The meeting considered document 12_101, regarding the transition period to be applied to Harmonised Standards under the R&TTE Directive. The transition period is the period after the publication of a Harmonised Standard that the superseded version can still be used to claim presumption of conformity.

A request from ERM EMC stop the work item related to EMC for analogue cellular equipment was noted. ERM EMC consider that the diminishing market requirement for these products is no longer sufficient to justify the standardisation effort.

In view of the urgency of these work items, ERM EMC requested that ERM delegate responsibility for the approval of the EMC standards concerning UTRA and CDMA2000 for Public Enquiry to ERM EMC.

The meeting considered document 10_110, draft REN/ERM-EMC-225-11 (EN 301 489-11) Electromagnetic Compatibility (EMC) standard for radio equipment and services; Part 11: Specific conditions for terrestrial broadcasting transmitters which had been approved at the ERM EMC meeting (San Jose).

Concern was expressed regarding

It was noted that a large number of broadcast experts had contributed to the draft and had been circulated to the EBU and to JTC Broadcast without comment. It was further noted that ERM TG17 had recently been established to deal with radio requirements for prevention of harmful interference under article 3.2 of the R&TTE Directive for broadcast transmitters.

It was considered that the draft could be approved for Public Enquiry provided that the scope would be restricted. A revised proposal was produced after discussion in a small group (document 12_124). The meeting did not support this proposal.

An ad-hoc group met in parallel session to resolve the outstanding issues. It was not possible for the ad-hoc group to reach a conclusion.

REN/ERM-EMC-225-11 (EN 301 489-11) was not approved

ERM EMC were asked to reconsider the outstanding issues. It was noted that a revised draft should be presented to ERM#13.

The meeting considered document 12_048 (DEN/ERM-EMC-221-3 (EN 301 843-3) Electromagnetic Compatibility (EMC) standard for marine radio equipment and services; Part 3: Specific Conditions for Maritime Mobile Earth Stations for the Global Maritime Distress and Safety System (GMDSS).

It was noted that RP01 did not intend to produce standards for this type of equipment.

The meeting considered document 12_044, draft REN/ERM-EMC-223 (EN 300 386 v 1.3.1) Telecommunication network equipment; ElectroMagnetic Compatibility (EMC) requirements.

The meeting noted document 12_058, an enquiry regarding ESD tests in EN 300 386-2. It was noted the requirement is to carry out both direct and indirect testing of electrostatic discharge, in accordance with the referenced basic standard (EN 61000-4-2). It was noted that the test method of the referenced basic standard shall apply when no deviations are given in the generic or product standard, such as the EN 300 386-2.

Telecommunication network equipment; ElectroMagnetic Compatibility (EMC) requirements

Public Enquiry

It was proposed to withdraw ETS 300 386-1, as ES 201 468 and TR 101 651 have now been published. After discussion, it was noted that ETS 300 386-1 was referred to in EN 300 386-2, which is a Harmonised Standard referenced in the Official Journal. It was noted that EN 300 386-2 has been replaced by EN 300 386 and then the EN 300 386-2 will not apply after the transition of EN 300 386.

A withdrawal vote for ETS 300 386-1 will not be initiated until end of the transition period of EN 300 386 (May 2003).

The meeting considered document 12_077r1, REN/ERM-EMC-225-1 (EN 301 489-1 v 1.3.1) Harmonised EN for ElectroMagnetic Compatibility (EMC) of radio communications equipment and services; Part 1: Common technical requirements

It was noted that the new draft could be used to demonstrate conformity in the absence of a product standard. It was further noted that the frequency band for radiated immunity requirements had been extended to 2 GHz and that the test levels for surges had been modified.

Harmonised EN for ElectroMagnetic Compatibility (EMC) of radio communications equipment and services; Part 1: Common technical requirements

Public Enquiry

The meeting considered document 12_005, the report of ERM RM.

The meeting considered document 12_019r1, a liaison statement on T-DAB. It was noted that this had been discussed in the RM group who had initiated liaison with JTC Broadcast. No information has been received up to now from JTC Broadcast. It was noted that at this stage the change of source coding was not supported by CEPT.

The meeting noted document 12_083, an ERO report on the 4th consultation round of DSI Phase III. It was noted that RM had not been able to discuss the DSI phase III in depth.

Issues related to the future use of the 2,45 GHz band were discussed under agenda item 13 Report from Task Group 11 (Radio LANs)

This had been raised under agenda item 1.4 European Commission Activities. The draft Council and Parliament Decision had been discussed and a draft letter from the ETSI Director-General (document 12_005 annex 4) was presented to the meeting. This was modified following discussion at the meeting. The resulting text is attached as Annex I: Letter to EC regarding radio spectrum policy.

To send a letter to the European Commission regarding the EC spectrum policy (Annex I: Letter to EC regarding radio spectrum policy).

It was noted that EP TETRA is reconsidering the limit values for the requirements relating to Adjacent Channel Power and Adjacent Channel Selectivity. Concerns were expressed by ERM RM members on the implications of such a relaxation (5 to 10 dB) on the efficient use of the spectrum and the usage of the adjacent bands by other systems (e.g. : GSM, PMR…).

To advise EP TETRA that Out of Band emissions are the responsibility of TC ERM, and requesting information on the planned changes to the TETRA standard in this area.

The meeting noted document 12_005 Annex 3 on a proposed ERC Decision on the withdrawal of frequencies for Cordless Telephones. ETSI has been asked to clarify to what extent Cordless Telephones are still supported by ETSI members. WG ERM RM has already agreed that CT2 should be treated differently from CT1 and CT1+.

After discussion, it was agreed that the appropriate text of annex 3 would have been:

The meeting considered document 12_092, a comment from Nortel Networks on the report regarding the timing for the removal of frequencies for cordless telephones, and document 12_126 (Ascom) providing information on the differences between CT1/CT1+ and DECT. Concern was expressed that the timescales for re-allocation needed to take account of the nature of a consumer market.

It was proposed to consider a phased withdrawal of frequencies with the following key dates:

A discussion took place in a side meeting, but it was not able to achieve a consensus position.

TG13 Chairman

Draft a response to CEPT/ERC RR for approval in ERM RM by correspondence.

It was noted that a consultation had taken place between TC SES, TM4 and ERM RM on the ERC Decision without consensus being reached. It was reported that the ERC Decision had now been approved by ERC and published under number ERC/DEC/(00)09.

It was noted that a draft version of the MoU had been briefly discussed by ERM RM, and had been circulated to the OCG with a request to provide comments to this meeting.

The draft MoU was discussed in an ad-hoc group, which considered documents 12_051, 12_052, 12_053 and 12_091, regarding the MoU. The output of the ad-hoc group is contained in document 12_127. After discussion in plenary session a revised version was produced (document 12_127r1)

ERM endorsed the draft ERC-ETSI Memorandum of Understanding (document 12_127r1).

To send the revised ETSI/ERC MoU for information to the OCG before the ETSI/ERC Officials meeting.

It was noted that there was a need for ETSI members to have access to working documents of ERC.

ERM RM

To circulate appropriate ERC working documents to ETSI members via its server.

It was noted that the CEPT/ERC FM had requested that the SRD Maintenance Group (formerly FM26) should be treated as a working group of ERC, which would be attended by a single ETSI representative, rather than a project team, to which attendance would be open to ETSI Full Members.

Following difficult discussions at the last meeting of ERM RM in Milan, a compromise had been reached (document 12_005 annex 2). Concerns were expressed at the meeting that the agreed compromise was not in line with the existing ERC/ETSI MoU, although it was noted that the RM position had been reached on the basis that the MoU with ERC was under negotiation.

It was agreed that RM should appoint a liaison officer to the CEPT/ERC FM SRDMG, who should use the same rules of engagement as liaison officers to other working groups of CEPT/ERC. It is expected that the Liaison Officer may need to be accompanied by technical experts to give him technical assistance during SRDMG meetings.

Mr Bolt Soerensen was appointed as the liaison officer to CEPT/ERC FM Short-Range Devices Maintenance group, to represent the ETSI view and to report to ERM RM.

It was reported that WG ERM RM had noted the final decision of ERC to close TG1 and to create one single group called PT1. ERM RM had decided to ask the existing Liaison Officer to TG1 to act as Liaison Officer to PT1.

Need of a Recommendation dedicated to out of band emissions

The meeting noted 12_005 annex 6, a Liaison Statement from WG ERM RM to all Technical Bodies involved in radio systems standards, including TC ERM.

This item was considered under item 1.4 European Commission Activities

It was noted that the proposal for 4W RFIDs in the 900 MHz band (allocated to TETRA) had been formally rejected by CEPT-ERC WG FM. No further work is going on in this area in ERM RM.

Tracing of Lost & Stolen Items (TLSI)

It was noted that CEPT-ERC PT FM39 was closed during the last WG FM meeting. It was reported that ERC are not pursuing action in this field, although standardisation activity is underway in ISO.

It was noted that RM had discussed at its Milan meeting a system reference document related to PLT. The meeting considered the liaison statement sent by ERM RM to EP PLT (document 12_005 annex 5). It was noted that the allocation of a radio frequency "chimney" in the HF band would be a lengthy process (taking many years) that would be unlikely to deliver the bandwidth requested by EP PLT.

It was noted that EMC limits are being developed in a joint working group with CENELEC that is also looking at limits for DSL and CATV systems. It was reported that the joint working group considered that PLT should meet the limits of EN 300 386 and EN 55022.

It was noted that the role of ETSI RM is to present the co-ordinated spectrum demands of ETSI. Concerns were expressed by some delegates that the response sent by RM to PLT did not give adequate information on the role of ERM RM in this respect. It was agreed that any relaxation of limits in comparison to those contained in relevant EMC standards would have to be agreed with ERC and ITU-R.

It was noted that a systems references document related to transponders in the LF & HF range, and another related to RFID systems based on ISO 14223, 11784, 11875 had been sent to CEPT/ERC. A systems reference document related to 2,45 GHz RLANs providing 4W eirp using directional antennas was under approval by correspondence.

Concerns were expressed that it was difficult to see which System Reference Documents were active and at what stage they were.

To provide a list of active Systems Reference Documents, including their status, to ERM#13.

The was noted that the frequency band 31.8-33.4 GHz had been newly allocated to the Fixed Service – for High Density Applications - by WRC 2000. Although CEPT-ERC WG FM stated that it was too early to make any decision yet on the usage of this new band, WG ERM RM had initiated an internal consultation between TM4, BRAN and ERM RM on the possible usage of this frequency band. Some WG ERM RM members already mentioned that there will be a need for the future 3G mobile network infrastructures.

The meeting noted document 12_060, recent Commission Decisions in relation to the application of article 3.3e of the R&TTE Directive to Marine and inland-waterway equipment. The meeting noted that no transition period had been allowed in these Decisions, which therefore were of compulsory application from their date of publication in the Official Journal of the European Communities.

It was noted that RP01 have started a programme to examine the spurious emissions requirements in all of its standards in the light of the recent ITU-R Recommendation SM.329-8.

It was noted that the GMDSS specifications of RP01 and of IEC TC80 were in need of revision in the light of developments in the IMO and ITU. A meeting had been planned with IEC in December to co-ordinate work programmes.

RP01 had noted difficulties caused by the fact that ETSI standards for the same equipment are cited in the Marine Equipment Directive and also in the Official Journal of the EC in respect of the R&TTE Directive. Difficulties have been experienced because the mechanism for maintaining the citations is different. This issue will be discussed in detail at the forthcoming RP01 meeting.

It was reported that RP01 were considering whether harmonized standards should be necessary for all non-SOLAS radars, following the example of radars used on inland waterways. The issue is under discussion on RP01. However, it was noted that CENELEC should be informed of any such standardization activity underway in ETSI.

The meeting noted documents 12_075 and 12_098, correspondence between TC SES and ERM RP01 regarding spurious emissions from maritime satellite earth stations. It was reported that this issue is still under discussion in RP01.

It was noted that Mr Caselius (TAC) was not in a position to continue as Chairman of RP01. Mr Caselius thanked the RP01 delegates and the Secretariat for the support during his time as Chairman.

The Chairman thanked Mr Caselius for his hard and professional work as the Chairman of the ETSI maritime group. This was supported by the applause from the meeting.

The meeting considered document 12_007, the report of ERM RP02.

It was noted that RP02 had resolved the Public Enquiry comments on EN 300 086, EN 300 113, EN 300 219 and EN 300 296 on behalf of TC ERM at meeting 9bis of ERM RP02. Revised versions had been sent to the Secretariat for National Vote. The output of ERM RP02 meeting 09bis is included in document 12_113.

The meeting noted that RP02 had considered the evolution of test report forms and application forms. It was noted that application forms were used for two purposes: manufacturers’ self testing and third-party testing.

It was proposed that, if test report forms and application forms are desired for particular standards, they should be developed by the technical bodies responsible for those standards. Responsible technical bodies should be encouraged to follow existing specific forms, rather than a model.

Concerns were expressed that enforcement authorities in different Member States may have different interpretations of the R&TTE requirements for test reports as part of the declaration of conformity. A test report form from ETSI would be useful for the guidance of enforcement authorities as well as for the assistance of manufacturers and test houses, although it was emphasised that such a report form would remain voluntary.

ERM considered that the model forms should be maintained covering the general aspects which are common to all forms. ERM noted that the forms were useful both inside and outside the EU. It was proposed to notify the European Commission and the RTTECA (ex-ADLNB) that ETSI intended to continue the development of application forms.

The meeting considered document 12_039r1, draft REN/ERM-RP02-049 (EN 300 471): Land Mobile Service; Rules for Access and the Sharing of common used channels by equipment complying with 300 113 (2 parts)

It was noted that EN 300 471 implements a "receive before transmit" regime allowing independent systems to share the same channel while minimizing harmful interference to other users of the channel. Its publication as a Harmonised Standard does not imply its compulsory application.

It was noted that PMR equipment operating this protocol normally operates independently of a network, under an individual licence and on frequencies that are not harmonized. Such equipment would therefore be "class 2" equipment. Manufacturers would therefore be required to notify the spectrum management authorities 4 weeks before placing it on the market of an EU Member State.

Concerns were expressed whether the protocol specified in the draft was relevant to article 3.2 of the R&TTE Directive. It was noted that users of shared channels could use such a protocol to avoid harmful interference to other users. Users with dedicated use of a channel would not have need of such a protocol.

The meeting noted document 12_040, the report if the study meeting into the Automotive EMC Directive carried out by York EMC Services for the European Commission. It was noted that the radio industry had made an active representation to the questionnaire produced by York EMC Services, and that a further meeting was planned to discuss the responses.

It was noted that the final draft version of the York EMC Services report was planned to be distributed to involved parties (DG Enterprise, ACEA, EACAM, ETSI, CLEPA) in January 2001, with a final presentation planned to the European Commission on 7 February 2001.

It was noted that there had been a meeting of ISO TC22 SC3 WG3 (see document 12_041) which was developing installation guidelines for radio equipment in vehicles. The draft guidelines currently recommend an external antenna for equipment with an output power greater than 100 mW.

It was noted that a recent ETSI/ACEA meeting reviewed the draft installation guidelines developed in ISO. It was reported that the final version (document 12_042) is being sent to vote in ISO.

It was noted that the installation guideline and the Automotive EMC Directive only cover installed equipment, not GSM portable terminals used in vehicles. It was noted that hand-held GSM portable terminals can exceed the recommended level.

It was proposed that the TR, which indicates a lack of immunity in EN 55020 for television receivers and EN 50083-2 for cable distribution systems, be sent to CENELEC with a request that CENELEC revise their standards.

It was noted that interference has been reported in Finland from TETRA into cable networks. The meeting anticipated that lack of immunity in TV cable distribution systems would become an increasing problem.

It was noted that the Commission had taken the position in TCAM 6 that broadcast receiving equipment which can receive outside the designated broadcast bands is also covered by the R&TTE Directive.

The meeting noted document 12_093, regarding the frequency range for spurious emissions in receive mode. It is noted that the upper limit of spurious emissions is not consistent between standards. This was considered to be particularly important in the case where multiple transmitters are installed in the same product.

It was noted that ITU-R have published a revised Recommendation on spurious emissions. The frequency range of the spurious emissions limits are dependent on the operating frequency of the transmitter. However, they are not consistent with the ETSI standards.

It was suggested that it was not reasonable to test the receivers over the same range as transmitters. It was suggested that the ETSI standards should be reviewed to bring them into line with the ITU-R Recommendation.

It was reported that similar issues were raised in TFES.

Test houses reported that tests of spurious emissions above 5 GHz very rarely find emissions that exceed the limits. It was suggested that the frequency range should be reviewed.

It was proposed that there should be a single set of limits for all radio equipment, independent of the product type, as they relate to the protection of the radio environment.

The meeting noted that a draft should be expected to be presented to ERM#15.

The meeting considered document 12_014, the report of TG13.

It was noted that TG13 has completed its task, and would thus normally be closed. However, it was proposed to maintain TG13 as a focus group for activities related to cordless telephony.

To send a letter to the European Commission regarding Harmonised Standards for DAB (Annex M: Harmonised Standards for DAB).

WP3 had discussed a liaison from FM requesting information on the number of radio microphones in circulation as an input to the process for replanning the analogue TV spectrum.

It was noted that given the European Union (EU) comments on the provision of at least 42% of all television and radio programs from within the EU, a lack of spectrum for radio microphones would severely hamper European companies in achieving this target. In addition existing fixed sites such as theatres; studios and conference halls would find their productions under threat from "interference" generated first by digital television and then by the projected reallocation and possible auction of spectrum in the range 470 – 862 MHz.

It was agreed that this issue should be brought to the attention of EU and CEPT FM.

A presentation was made by Mr Stéphane Tronchon, the ETSI Secretariat (document 12_054) regarding:

Members were reminded of their duty to inform the ETSI Director-General of any essential IPRs in standards or technical proposals that they become aware of. It was questioned whether the normal IPR statement is applicable to EMC standards for 3GPP. It was confirmed that the 3GPP agreement states that IPR policy of the relevant organisational partner applies.

It was reported that the fine that can be imposed for abuse of competition law can be of the order of 10% of the turnover of the offending company.

The meeting considered document 12_067, a draft revision of EN 300 433 (2 parts) on Amplitude Modulated Citizens’ Band equipment, correcting editorial errors.

ERM#14 is planned to take place from 18 to 22 June 2001 at a location to be defined.

ERM#15 is planned to take place from 15 to 19 October 2001 at a location to be defined (Note: this is a change of date from 5 to 9 November 2001)

The meeting considered the Terms of Reference of TC ERM and its subgroups and concluded that no immediate changes were necessary other than those identified elsewhere in the meeting report.

Project Type: The review and, if needed, revision of harmonized standards under article 3.2 of the R&TTE Directive prepared by TC-ERM groups taking account of recent decisions agreed within TCAM as identified below.

Reports to: TC-ERM

Title: Review and, if needed, revision of harmonized standards under article 3.2 of the R&TTE Directive prepared by TC-ERM groups.

Purpose: To review and, if needed, to revise harmonized standards under article 3.2 of the R&TTE Directive prepared by TC-ERM Task and Working groups in the land mobile sector taking account of recent decisions agreed within TCAM. The Commission Services have expressed their concern that harmonized standards prepared within TC-ERM contain parameters not considered to be "essential", by them in the framework of the R&TTE Directive.

This activity is based on changes agreed within TCAM and advised by the Commission Services that have in most cases occurred after the documents were drafted. The Commission Services have agreed to publish the references of the non-revised documents in the OJEC on an interim basis pending their revision by ETSI as indicated.

Aspects identified for possible revision include, but are not limited to: environmental conditions, receiver parameters and test methods, due account needs to be taken of the ongoing discussions in TCAM and the requirement that spectrum management authorities publish their spectrum planning criteria.

Land mobile standardization activities within TC-ERM are presently undertaken in RP02, RP08, TG11, TG13, and TG17 and general air interface aspects in TG14.

Task: The task is (a) to prepare a list of harmonized standards and report to TC-ERM by correspondence; then (b) confirm with the Commission Services which parameters constitute an essential requirement under the R&TTE Directive; and then (c) use the list in (a) above to revise the identified harmonized standards, based on agreement with the Commission Services at (b) as to their content.

The activity relates to the standards prepared within TC-ERM, but some aspects are relevant to all of the ETSI groups responsible for preparing harmonized standards.

The Task Group needs to advise other ETSI technical bodies, the R&TTE Steering Committee and STF 149,of the decisions taken with the objective of achieving a harmonized approach across all ETSI technical bodies. This task is to be undertaken in close collaboration with all of the concerned parties within TC-ERM noting that the responsibility for the revision of these documents is delegated to the Task Group by TC-ERM.

Timetable: The initial list of relevant harmonized standards task (a) and agreement with the Commission Services in (b) is to be circulated to TC-ERM by correspondence for information, by the end of December 2000. The group is then to provide TC-ERM 13, with revised set of draft documents task (c) for approval (OAP, in principle) by TC-ERM under ETSI Technical Working Procedures.

Note: To minimize the possibility of confusion and potential nugatory work, when the list of harmonized standards identified as (a) above is determined, i.e. by December 2000, a standstill is to be implemented in respect of all of the related "part 1" standards.

DRAFT TERMS OF REFERENCE

TFES: TC MSG / TC ERM Task Force

For the production of Harmonised standards under the R&TTE Directive for IMT-2000

1. Responsibility

The group is responsible for developing European Norms (ENs), intended to become Harmonised Standards under the R&TTE Directive, for members of the IMT-2000 family.

The group should organise its work to ensure that, as far as possible, Harmonised Standards are available to meet market needs and timescales for placing on the market and putting into service of IMT-2000 equipment within the European Community.

2. Scope

The scope of the work is to develop ENs applicable to the following four members of the IMT-2000 family of radio interfaces, as defined in ITU-R Recommendation M.1457 (formerly known as IMT.RSPC):

The group will co-ordinate with EP DECT on the development of ENs applicable to IMT-2000 FT and with TC SES on ENs applicable to the IMT-2000 satellite component.

The technical work of the group will be limited to Essential Requirements falling under part 2 of Article 3 of the R&TTE Directive. However, work may also be required in respect of Part 3 of Article 3 if the Commission makes a decision in respect of this Part that is applicable to IMT-2000. The group may liaise with the groups with responsibility for Part 1 of Article 3, and may use specifications developed by these groups in its deliverables, where appropriate.

2.1 Deliverables

The group will develop one or more ENs. These should be produced in a modular structure with common/generic parts and specific parts. The structure will be a trade-off between minimising duplication of content and enabling completed parts of the work to proceed to public enquiry in a timely manner.

3. Life Cycle

The group should endeavour to ensure that a first release of draft ENs are ready for approval for public enquiry by Q1, 2001.

It is envisaged that the group will develop a second release of draft ENs during 2001, for those aspects of IMT-2000 which could not be included in the first release. It is possible that further releases may be required; the group will then be closed, following public enquiry resolution and vote of the final release of its draft standards.

4. Relations with bodies inside ETSI

The group will report on administrative matters to MSG or ERM as appropriate.

On technical matters, the group will report to one or both of ERM and MSG as appropriate.

The group should maintain close liaisons with ERM/RM on the following issues:

5. External Relations

5.1 ERC

The group will base its work on:

The group may liaise with the group or groups within ERC with responsibility for IMT-2000 on these matters, while maintaining involvement of ERM/RM.

5.2 ITU/R

The normal method of liaison with ITU/R WP8F will be through individual members. The conclusions of this group will be a valuable input to the work of WP8F. The group should also take account of the work of WP8F.

If a direct liaison with WP8F is needed, the liaison will be prepared in collaboration with ERM/RM.

5.3 SDOs

The group will take account of the continuing development of IMT-2000. In particular, it will seek to base its work on the most recent versions of the specifications of the SDOs that are referenced in ITU-R Recommendation M.1457.

The group will liase with SDOs responsible for the other IMT-2000 family members.

6 Membership

The work is open to all ETSI members.

As this work will be based in part on the work of other SDOs, participants in these groups will be welcome to contribute to the work. If an interested party is unable to participate through an ETSI membership, the chairman shall extend an individual invitation.

7 Resourcing

7.1 Members

The technical work will be through members’ contributions.

7.2 ETSI Secretariat

The Mobile Competence Centre will provide administrative support for meetings.

7.3 STF 149

It is expected that STF 149 will provide support in the preparation of ENs. This will be primarily to ensure that the standards meet the legal requirements of the R&TTE Directive.

Title: Reply to liaison statement regarding the maintenance of TBRs

ETSI ERM meeting 12 (Sophia Antipolis, 6 to 10 November 2000) considered a liaison statement from AT regarding the maintenance of TBRs.

TC ERM takes note of the interesting work underway in AT. ERM has one active standardisation activity which was covered by a TBR, the Terrestrial Flight Telecommunications System (TFTS), which was covered by TBR 23. ERM has developed a Harmonised Standard under the Radio and Telecommunications Terminal Equipment Directive (1999/5/EC) covering this application. The standards upon which the Harmonised Standard is based are being maintained as ENs or TSs as appropriate.

ERM notes the survey on non-radio TBRs, but is not in the position to comment as none of these TBRs fall within the area of expertise of ERM.

The Technical Committee would like to remind you of the role of ETSI in developing European Standards which are used in the regulation of radio communications equipment, and the relation that ETSI has with the CEPT/ERC (see below).

There is a close link between technical standards for radio equipment and the regulations necessary to ensure economic use of the radio spectrum and to avoid interference. Indeed, under the R&TTE Directive (1999/5/EC), Harmonised Standards from ETSI are de facto spectrum management tools.

ETSI has a Memorandum of Understanding with the European Radiocommunications Committee (ERC) of the European Conference of Post and Telecommunications Administrations (CEPT). TC ERM is the ETSI Technical Body responsible for operating this Memorandum of Understanding. This work is delegated to its Radio Matters working group.

Since ETSI produces Harmonised Standards under the Radio & Telecommunications Terminal Equipment Directive (1999/5/EC), under a mandate from the European Commission and these standards are cited in the Official Journal of the European Communities, they give a presumption of conformity to the essential requirements of the R&TTE Directive and hence provide access to the market.

Looking at the proposed Decision, ETSI would like to make you aware of its role in developing European Standards for radiocommunications equipment, and seeks means to co-operate in the implementation of this new Decision.

ETSI Representation in the Short-Range Devices Maintenance Group (SRD MG):

It was reported by Liaison Officer with CEPT WG FM that, at the last WG FM, the Chairman of the SRD MG Chairman raised the issue on the question of representation of ETSI within his group.

It was noted that SRD MG is a permanent group which reports to FM WG. It was not clear therefore who had the right to participate to the MG. However, at FM WG, it was stated that the same rule as for a WG would apply to the SRD MG i.e. official representatives of organisations like ETSI, EICTA, etc… are requested.

It was noted by WG ERM RM that the majority of the subjects treated in the SRD MG are related to Short-Range Devices. Historically, the majority of Short-Range Devices are standardised within ETSI TC ERM WG RP08. For this reason a representative from ETSI ERM RP08 (Mr Sigurd Bolt Soerensen) has always attended SRD MG.

Noting that the CEPT/ERC WG FM have requested to formalise ETSI representation to SRDMG, ETSI wishes to inform FM that significant standardisation activity that affects the work of the SRDMG is carried out in working groups other then ERM RP08. For example, ERM TG11 covers radio LANs operating in the 2,45 GHz band; ERM TG13 covers cordless telephones; ERM TG17 covers inter alia radio microphones; EP BRAN covers HIPERLAN.

ETSI ERM has therefore decided to appoint a liaison officer to the SRDMG, who will report to ERM RM and will represent a co-ordinated ETSI position to SRDMG. It is expected that the Liaison Officer may ask to be accompanied from time to time by technical experts to give him technical assistance during SRDMG meetings.

ETSI are pleased to appoint Mr Sigurd Bolt Soerensen as Liaison Officer to the SRDMG.

At the October meeting of ERM TG17 WP 3 dealing with Radio Microphone issues a reply from the Radio Microphone Manufactures to the WG FM questionnaire was tabled, (a copy is attached) concern was expressed by all present that the number of users far outstripped the reduced spectrum allocations during the period of Digital Television implementation. We believe this issue was also highlighted by the FM27 report when the 1785 – 1800 MHz band was under consideration for a harmonised band for touring shows etc.( Equipment will not be available for at least 18 months)

Given the European Union (EU) comments on the provision of at least some 42% of all television and radio programs from within the EU a lack of spectrum for radio microphones will severely hamper European companies in achieving this target.

After consideration of the replies received from their questionnaire, would WG FM please keep WP3 informed of their intentions to alleviate the problem during the transition period and how the use of radio microphones will be catered for after the analogue switch off, given the recent publicity on the reuse and auctioning of spectrum in bands four and five by National Administrations.

Members of ERM TG17 WP3 would be pleased to provide a presentation on the use and problems of radio microphones to WG FM if this would assist their deliberations.

For your information the following report was received by the 12th meeting of ETSI ERM (6 to 10 November 2000, Sophia Antipolis)

At the Helsinki meeting of ETSI ERM a task group was set up (TG17) to produce standards for Broadcast Transmitters under article 3.2 of the R&TTE directive, at the inaugural meeting of the Task Group in October no interest was shown in producing appropate standards for Digital Audio Broadcasting (DAB). Approaches to the European Broadcasting Union, Administrations and others have so far failed to find a Chairman for this working group. Therefore TG17 are unable to start on the DAB standard work at this time.

Statement of Mr de Brito (Chairman, ERM RP02)

The Chairman of WG ERM RP02, having asked for the floor a significant number of times In view of making proposals for enhancements of the Terms of Reference for TG18, in relation with 4 different points, without any chance to express his views and not even to list the following points:

1. expresses his deep regret concerning the way in which the views of the chairman of one of the WG directly concerned by the work being discussed have been disregarded

2. noting that there is no evidence that any difficulty has been quoted in relation to RP02 standards, requests that RP02 standards are not handled by the TG.

France Telecom would like that the following text be included (without changes) in the Summary Record of TC ERM #12, under the relevant agenda item:

- Beginning of statement -

1- During the meeting, while discussing document ERM12_122, France Telecom requested to add at the end of the first paragraph in the Purpose area the following sentence, reflecting an extract (in the paragraph "Requirements on radio receivers") of the approved summary record of the 13th meeting of SC_RTTE, where the Commission was present. The sentence reads "The Commission is of the opinion that there should be no requirements on receive-only equipment under article 3.2 but that there may be requirements if the receivers control transmitter operation".

2- Furthermore, France Telecom had asked the floor to mention that TC ERM’s view on receiver parameters has always been and still is that Technical Bodies are responsible of the drafting of their standards and that receiver parameters have to be treated on a case by case basis. It means that receiver parameters may be needed. France Telecom would like to recall the following views of TC ERM :

"Receiver parameters under the R&TTE Directive.

The meeting considered the general issue that it was necessary to specify requirements on receiver performance in order to avoid harmful interference. It was noted that the absence of effective receiver performance of short-range devices is causing difficulties in the deployment of TETRA in the UK.

It was also considered by TC ERM that a poor quality receiver could be responsible for harmful interference being caused in systems that use automatic re-send when an excessive number of attempts to retransmit block the channel. "

"The meeting noted that the majority of receiver requirements are not considered relevant for article 3.2 of the Directive. Receiver sensitivity is required, however, as the systems have to listen successfully for a clear channel before transmitting."

"Receiver parameters

The meeting noted a contribution from RP08 TG3, endorsed by RP08, (document 11_097) on the receiver parameters considered by ERC to be necessary to demonstrate compliance to article 3.2 of the R&TTE Directive.

The meeting agreed with the principle of the Recommendation, that it is necessary to specify receiver parameters in defining systems that use the radio spectrum effectively. Certain delegates considered that the Recommendation is difficult to implement nationally. It was noted that the details of the technical requirements necessary to demonstrate compliance with the R&TTE Directive will be specific to each specific technology and will be specified by the relevant Technical Body.

The meeting also agreed that information regarding typical receiver parameters would be of use to ETSI and CEPT compatibility studies."

3- France Telecom believes that point 1 and 2 above are essential views that would have been necessary to be included in the Purpose area of ERM12_122 (ToRs of ERM-TG18) in order to give a clear background and view of the all parties involved here.

Project Type: Study of developments in relation to cordless telephony

Title: TG13 Cordless Telephony

Purpose: The preparation of a draft ETSI Harmonised Standard to cover the essential requirements under Article 3.2 of the R&TTE Directive, of CT1, CT1+ and CT2 apparatus. To act as a continuing centre of expertise in this area.

Timetable: Ongoing

Task: The task is to prepare a draft ETSI Harmonised Standard, that can be used by manufacturers of CT1, CT1+ and CT2 equipment to declare compliance to article 3.2 of the R&TTE Directive. To act as a focus for activities related to cordless telephones.
